Flexiant is committed to respecting and protecting the privacy of visitors to our websites as well as the privacy of our customers.

For visitors, we’ve structured our websites so that you can visit us on the web without identifying yourself or revealing any personal information.

For Flexiant Cloud Orchestrator customers (including free trial customers), we additionally collect information about your business, in order that we can support your use of the product.

For Flexiant customers, once you choose to provide us with personally identifiable information (any information by which you can be identified), you can be assured that it will only be used to support your customer relationship with Flexiant, and will never be passed on to any other companies other than those within Flexiant’s own group.

 

Visitors To Our Website

This section applies when you visit our website, whether or not you sign in.

What information do we collect?

When you visit our website, our web server collects basic user information about you that includes your IP Address, the time you accessed our website and the pages from within our website that you visit.

We may at times also use cookies, which are small pieces of information that a website can store in a designated file on your computer. Cookies allow a web application to respond to you as an individual, for example, to remember previously stored preferences that you may have selected.

How do we use this information?

The basic user information collected is used to help us analyse web traffic and to improve the content of our website. Cookies may be used to facilitate your customer interaction with us. For example, we may use a cookie on the landing page of products sold online which records the customer information that is required on the order form, and then forwards this information to our internal sales tracking database.

We may from time to time disclose to third parties aggregate information on our website’s traffic profile. For example, Internet advertising companies may require this data to help us better target our advertisements on our website(s) and/or other websites, this will not however reveal any personal identifiable information whatsoever.

Note that our website provides links to products and services offered by other companies; the company’s website that you link to will be able to determine that you linked from our website.

 

Flexiant Cloud Orchestrator Customers (including free trials)

This section applies in addition to the above section if you create an account on our website, or sign in using an account you have previously created.

What information do we collect?

When you create an account, we collect your name, the name of your company, its address, and various contact details. We also determine how often you visit our site, and what you have downloaded. If you report support tickets, we collect the information you provide within those support tickets.

We may also collect other information as set out in the terms and conditions of your free trial, or your contract for a paid licence.

How do we use this information?

We use the contact information you provide us with to provide you with a licence, and to support your service. We also use it to identify you, either online (for instance should you raise a support ticket), or offline (for instance if you ring in by telephone).

If you have downloaded an evaluation or trial edition, we use this information so that our sales team can establish how your evaluation is progressing, and make contact with you to determine whether you would like to upgrade to a paid edition.

Flexiant will use customer information to provide customers with system information or information about new or upgraded products.

We will not otherwise disclose customer personal and account information unless we have reason to believe that disclosing such information is necessary to identify, make contact with or bring legal action against someone who may be causing harm or interfering with the rights or property of Flexiant, our customers, or others, or where Flexiant has good belief that the law requires such disclosure.

 

Flexiant Customers

What information do we collect?

When you sign up for Flexiant products (including Flexiant Cloud Orchestrator and Flexiant Concerto), you provide us with both contact and payment information. Contact information typically includes your name, address and phone number. Payment information typically includes your credit card number or other payment details.

While you are a Flexiant customer, we manage information with regard to your account status, choice of services and customer logs including details of any phone calls and e-mails you send us. In addition, we store customers’ electronic mail and other communications as a necessary incident to the transmission and delivery of those communications.

How do we use this information?

We use the contact information you provide us with to establish our service for you. For customers receiving Flexiant Concerto, contact information will also be sent to a third party, New Relic Inc. or a related business, to facilitate the customer being automatically registered to receive services from New Relic Inc. or such related business.

We use payment information for payment processing purposes only. Where we use third party suppliers to process payments on our behalf, payment information will be transferred to such third parties who will use such information only for the purpose for which it is provided.

We create and maintain other information such as customer account status, choice of services and customer logs in the normal course of providing a service.

Flexiant will use customer information to provide customers with system information or information about new or upgraded products.

We will not otherwise disclose customer personal and account information unless we have reason to believe that disclosing such information is necessary to identify, make contact with or bring legal action against someone who may be causing harm or interfering with the rights or property of Flexiant, our customers, or others, or where Flexiant has good belief that the law requires such disclosure.

Neither will Flexiant, except for reasons stated below, disclose to third parties the contents of any electronic mail or other electronic communications that Flexiant stores or transmits for its customers. The circumstances under which Flexiant will disclose such electronic customer communications are where:

  • It is necessary in order to provide service to the customer;
  • It is necessary to protect the legitimate interests of Flexiant or its customers;
  • It is required to cooperate with interception orders, warrants or other legal processes that Flexiant determines in its sole discretion to be valid and enforceable; or
  • It is necessary to provide to a law enforcement agency when the contents are inadvertently obtained by Flexiant and appear to pertain to the commission of a crime.

Flexiant has no intention to censor, edit or engage in ongoing review or surveillance of communications stored on or transmitted through its facilities by customers or others. Flexiant will, however, review, delete or block access to communications that may harm Flexiant, its customers or third parties. The grounds on which Flexiant may take such action include, but are not limited to, actual or potential violations of the terms and conditions for Flexiant.

 

General

Customers may opt out of receiving newsletters and/or notices of new or upgraded products from Flexiant by sending a request to privacy@flexiant.com. In this request, customers must identify their domain name and contact information.

Please note, however, that Flexiant reserves the right to send bulletins and other important information regarding our services at our discretion to ensure reliable continuation of service for the customer.
